These Terms of Service govern your use of tabbytux.com and purchases from TabbyTux. By visiting the site or placing an order, you agree to these Terms. If you do not agree, do not use the site.

Online store terms

You must be legally able to enter into a binding agreement in your jurisdiction to place an order. You may not use our products or services for an unlawful purpose, violate applicable law, transmit malicious code, interfere with the site, or attempt to access systems or data without authorization.

Products and information

We work to present product descriptions, images, colors, prices, availability, and other information accurately. Displays and handcrafted or small-batch items can vary, and we do not warrant that every image or description will be error-free. We may correct errors, update information, limit quantities, or discontinue products at any time.

Orders and payment

Your order is an offer to purchase. We may accept, reject, or cancel an order, including for suspected fraud, pricing or inventory errors, payment issues, shipping restrictions, or quantity limits. If we cancel an order after payment is captured, we will refund the affected amount to the original payment method. You agree to provide current and accurate billing, payment, contact, and shipping information.

Prices and charges

Prices can change without notice. Taxes, shipping charges, duties, and other fees are displayed at checkout when applicable or may be imposed by authorities in the destination country. You are responsible for charges disclosed at checkout and for import charges unless we expressly state otherwise.

Shipping, returns, and refunds

Orders are also governed by our Shipping Policy and Refund Policy. Delivery dates are estimates, and carrier or customs delays can occur outside our control. Mandatory consumer rights in your jurisdiction are not limited by these Terms.

The TabbyTux name, site design, graphics, written content, and other original materials are owned by or licensed to TabbyTux and are protected by applicable intellectual property laws. You may use the site for personal, non-commercial shopping. You may not reproduce, distribute, sell, scrape, or exploit site content without written permission.

Third-party services and links

The site may rely on Shopify and other third-party services or link to third-party websites. Those services may have separate terms and privacy practices. We are not responsible for third-party content, availability, or conduct, although this does not exclude responsibility that cannot legally be excluded.

Reviews and submissions

If you submit a review, image, suggestion, or other content, you confirm that you have the right to share it and that it is not unlawful, deceptive, abusive, or infringing. You grant TabbyTux a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, and display that content in connection with the store and its promotion. We may remove submissions that violate these Terms.

Disclaimer

To the fullest extent permitted by law, the site and services are provided on an as-available basis. We do not guarantee uninterrupted or error-free access. Product safety instructions and age guidance must be followed. Cat toys should be used with appropriate supervision and inspected regularly for damage.

Limitation of liability

To the fullest extent permitted by law, TabbyTux will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the site or products. Where liability cannot be excluded, it is limited only to the extent permitted by applicable law. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded or limited.

Indemnification

To the extent permitted by law, you agree to indemnify TabbyTux against third-party claims arising from your unlawful misuse of the site, violation of these Terms, or infringement of another person's rights.

Changes and termination

We may update these Terms by posting a revised version on this page. Changes apply from the stated update date and do not remove rights already attached to a completed purchase. We may suspend access to the site when reasonably necessary to protect users, the store, or third parties.

Severability and governing law

If any provision is found unenforceable, the remaining provisions continue in effect. These Terms are governed by the laws applicable where TabbyTux is established, without overriding mandatory consumer protections or rights available where you live.
